ATTENDEE AGREEMENT   FH IN-PERSON 2025

Agreement with the Attendee Agreement Waiver form is required for all Fiddle Hell participants, attendees, artists, and staff for Nov 13-16, 2025, in Westford, MA. You will be able to sign a paper copy waiver form on arrival at Fiddle Hell. Thanks for your participation in Fiddle Hell and agreement with these conditions.

If you are the parent or guardian of a teen (13-17) or kid (12 or under) who will be attending Fiddle Hell, you’ll need to sign a paper copy of this waiver form on their behalf. This can be done on the day you arrive at Fiddle Hell if you will yourself be attending, or beforehand (download the waiver form at the link at the bottom of this page) if a different responsible adult will be attending with the teen or child. When the parent, guardian, or responsible adult arrives at Fiddle Hell, they will also need to agree to conditions about supervision of the teen or kid on the premises of the Westford Regency, where Fiddle Hell will take place. TO BE AGREED TO DURING REGISTRATION

I expressly agree that, as a participant, attendee, instructor, performer, and/or staff member, in workshops, jams, concerts, and any and all other activities related to the Nov 13-16, 2025, Fiddle Hell Massachusetts Festival (“FH”), I assume any and all risks associated with traveling to and from, participating in, and/or attending the 2025 Fiddle Hell Massachusetts Festival.

I expressly agree that Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns shall not be liable or responsible for any injury to me or others, or any damage to or loss of my property or that of others, including musical instruments. I release, acquit, discharge, and agree to hold harmless Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns against any claim, loss, liability, bodily injury, infection, illness, death, damage, or expense to myself or my property, or others or their property, which I may, directly or indirectly, sustain or suffer as a result of participation in and/or attendance at FH, including, but not limited to, any and all liability caused by or contributed to by the negligence and/or gross negligence of Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns, or FH participants or attendees. In addition, in consideration for their permission granted to participate in any and all FH activities, I agree to INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the persons and entities named above for all claims, demands, causes of action and legal liability (including, without limitation, any economic and/or non-economic losses), whether known or unknown, anticipated or unanticipated, for bodily injury, infection, illness, death, property damage, and/or property theft, arising from or relating to participation in any and all FH events. This waiver and release for liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I understand that the novel coronavirus, Covid-19, is a recognized pandemic and federal, state, and local governments along with federal and state health agencies are creating or modifying regulations regarding events and social gatherings as the pandemic landscape changes. I understand that Fiddle Hell Massachusetts LLC is following current and forecasted conditions, and listening to national and local experts, to determine Covid-19 safety protocols (and to modify them at the sole discretion of Fiddle Hell Massachusetts LLC). Covid-19 is contagious and evolving; I understand that neither FH nor the Fiddle Hell Massachusetts LLC is able to guarantee that a FH participant, attendee, instructor, performer, and/or staff member will not become infected with the Covid-19 virus or any other infectious disease whether prior to, traveling to and/or from, participating in, and/or attending FH.

I understand that participation in FH includes risk of exposure to and illness from infectious diseases including but not limited to Covid-19, and I agree that attendance is at my own risk. With respect to my participation in FH, I understand and agree to follow the following five safety protocols for myself (and for any child/children I am accompanying):
(1) COVID VACCINATION IS OPTIONAL AT FH. Evidence indicates that Covid vaccines are highly effective at making the disease milder and may also reduce the spread of disease. 
(2) MASKING IS OPTIONAL AT FH, including workshops, jams, and concerts. Evidence indicates that masking works very well in mitigating the transmission of airborne disease, which may be especially important for those who with increased risk factors.  Free masks (both surgical and higher-filtration N95, KN95, or KF94 masks) will be available at FH to anyone who would like them.  In the main concert hall, there will be a masks-only section for those wishing to sit near others who are also masked.
(3) If I feel unwell at all, have had a positive Covid test result, or have had Covid very recently (with a positive test or symptoms beginning less than 10 days before FH), or have a household member with Covid, I agree to not attend FH.  Covid symptoms include fever or chills, cough, shortness of breath or difficulty breathing, fatigue, muscle or body aches, headache, new loss of taste or smell, sore throat, congestion or runny nose, nausea or vomiting, and diarrhea. I understand that if I am unable to attend due to illness, a positive test result, or a household member with Covid, FH will refund tickets purchased in advance, if I provide documentation of the situation. 
(4) If I develop symptoms consistent with Covid or test positive for it while attending FH, I agree to communicate this situation immediately to the FH staff. I understand that under these circumstances,will be asked to put on a mask and leave the event immediately and will be entitled to a pro-rated refund of my ticket price. 
(5) If I violate either of protocols (3) and (4), I recognize that my FH attendance may be restricted or terminated at the discretion of FH without a refund of my ticket purchase price.

I understand that each registration is valid for one participant or attendee only at FH, a program presented by Fiddle Hell Massachusetts LLC, for only the days covered by my ticket purchased during registration. I understand that the workshop, jam, and concert schedule as advertised is subject to change before and during FH due to instructor and/or performer illness, technical issues, or other unanticipated factors.  I will not hold Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, or assigns liable nor be due a refund in the event of rescheduling or cancellation of any sessions at FH.

I agree to abide by the Westford Regency Inn’s restrictions that alcohol consumed in public areas of the Inn must be legally purchased from the Inn and legally consumed. I agree to abide by FH signage and regulations about jam session locations, and about function room capacity limits and opening and closing times.

I understand that Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns may use photographs, audio, or videos of participants for promotional purposes.  As a registered attendee, I release and discharge Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns acting on their behalf from any and all claims and demands arising out of or in connection with the use of the photographs, audio, or videos.  I irrevocably grant unlimited permission to Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns to use said photographs, audio, or videos for any promotional purpose in perpetuity and I understand that I shall not be entitled to any compensation therefor.

I agree to be a responsible and respectful user of the Whova technology prior to, during, and after FH. I agree to not share Whova passwords with attendees or non-attendees. I understand that multiple concurrent sign-ons using the same email address will not be accepted by the Whova platform.  I agree not to post inappropriate or derogatory photos, videos, comments, messages, links, or other material. I agree not to engage in cyberharassment, online bullying, or any activity prohibited by this agreement or by law, during FH sessions and afterwards. I understand that it is not permitted to download any FH videos (workshops, concerts, or jams) from Whova, and I agree to not attempt to do so in any form. I understand that audio recording of FH workshops and jams is generally allowed for my personal use only, unless a teaching artist requests no audio recording. I agree not to record audio or video of concerts at FH, including the Thursday, Friday, and Saturday Night Concerts. If I violate these requirements on Whova use and/or recording, I recognize that my FH attendance may be restricted or terminated at the discretion of FH without a refund of my ticket purchase price. 

I understand that the use of Whova on my laptop, tablet, or phone may be adversely impacted at any time by wireless availability, internet speed, simultaneous Internet use at my location, software settings, and other factors. I will not hold Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, or assigns liable nor be due a refund in the event of technology difficulties or errors on my part, by Whova, and/or by FH.

I agree to abide by the Privacy Policy of Fiddle Hell Massachusetts LLC, which can be read online and/or printed at https://fiddlehell.org/policies/privacy . I agree to abide by the Privacy Policy of Whova, the event management software used by Fiddle Hell Online, which can be accessed at https://whova.com/privacy/ .  If I reside in the European Economic Area, I understand that I may have the right to exercise certain privacy rights under applicable laws. FH will process such requests in accordance with applicable data protection laws.

This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without giving effect to any choice or conflict of law provision or rule. I irrevocably submit to the exclusive jurisdiction and venue of the federal and state courts located in the Commonwealth of Massachusetts in any legal suit, action, or proceeding arising out of or based upon this agreement or my participation in FH.

I CERTIFY THAT I HAVE READ THIS LIABILITY RELEASE, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT FREELY AND VOLUNTARILY.

ATTENDEE AGREEMENT   FH ONLINE 2025

TO BE AGREED TO DURING REGISTRATION

I understand that each registration is valid for one attendee only at Fiddle Hell Online (“FHO”), a program presented by Fiddle Hell Massachusetts LLC. I agree that any additional household member wishing to attend any concerts, workshops, or jams must also register (at a reduced price).  I agree not to share Whova passwords, Zoom meeting links, or video replay links with attendees or non-attendees. I understand that multiple concurrent sign-ons using the same email address will not be accepted by the Whova platform. 

I understand that signing up for a free Zoom account and installing the Zoom application on my laptop, tablet, or phone are strongly suggested for the best listening, viewing, and participation experience for FHO. Zoom does not knowingly allow children under 16 to sign up for their own accounts.

I understand that I have the right to disable my audio and video and to anonymize my display name (e.g., by setting it to “Anon”) at any time during FHO in Zoom meetings through Zoom controls. I agree that if I enable audio or video or do not anonymize my display name, livestream feeds and recordings of my audio, video, display name, and still image may be audible and visible to others attending FHO sessions, during the event (April 3-6, 2025) and for up to nine months after the event, and I give my permission for these feeds and recordings to be audible and visible. When replaying a previously recorded video, participant audio and video cannot be enabled, so such disabling or anonymizing is not necessary or possible. 

I understand that Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns may use photographs, audio, or videos of participants for promotional purposes.  As a registered attendee, I release and discharge Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns acting on their behalf from any and all claims and demands arising out of or in connection with the use of the photographs, audio, or videos.  I irrevocably grant unlimited permission to Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns to use said photographs, audio, or videos for any promotional purpose in perpetuity and I understand that I shall not be entitled to any compensation therefor.

I agree that I will disable my audio and video in Zoom sessions at FHO if children 12 or under, whether attending FHO or not, might be audible or visible in my location. This requirement to disable audio and video in the presence of children 12 or under, and my agreement with the requirement, are intended to comply with the protections of the Children's Online Privacy and Protection Act and the regulations thereunder (COPPA). I agree that a parent or legal guardian 18 years old or older will supervise and ensure the safe and appropriate participation in FHO activities by any children aged 17 or younger. I will only register a child 12 or under for FHO if I am that child’s parent or legal guardian and agree that I will read, accept, and follow all the terms of the separate FHO Parent or Guardian Agreement for Child 12 or Under, which can be accessed at https://fiddlehell.org/policies/parent-or-guardian-agreement-for-child-12-or-under.

I agree to abide by the Privacy Policy of Fiddle Hell Massachusetts LLC, which can be read online and/or printed at https://fiddlehell.org/policies/privacy. I agree to abide by the Privacy Policy of Whova, the event management software used by Fiddle Hell Online, which can be accessed at https://whova.com/privacy.  I agree to abide by the Privacy Policy of Zoom, used for online meetings with audio and/or video during and following Fiddle Hell Online, which can be accessed at https://zoom.us/privacy.

If I reside in the European Economic Area, I understand that I may have the right to exercise certain privacy rights under applicable laws. FHO will process such requests in accordance with applicable data protection laws. 

I understand that the workshop, jam, and concert schedule as advertised is subject to change before and during FHO due to artist illness, technical issues, or other unanticipated factors.  I will not hold Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, or assigns liable nor be due a refund in the event of rescheduling or cancellation of any sessions at FHO.

I agree to be a responsible and respectful user of the Zoom and Whova technologies. I will mute myself conscientiously on Zoom, and will follow instructions from FHO staff and from artists regarding muting during FHO sessions. I agree not to post inappropriate or derogatory photos, videos, comments, messages, links, or other material. I agree not to engage in Zoom bombing, cyberharassment, online bullying, or any activity prohibited by this agreement or by law, during FHO sessions and afterwards. I agree not to share my screen unless invited by a FHO instructor. If I violate these requirements, I recognize that my FHO attendance may be restricted or terminated at the discretion of FHO without a refund of my ticket purchase price.   

I understand that it is not permitted to download any FHO videos (workshops, concerts, or jams) and I agree to not attempt to do so in any form. Aside from any unforeseen technology issues, all session videos will be replayable during the event and for three months (extensible to six or nine months) afterwards to FHO attendees, through the Whova event portal on laptops, desktops, tablets, and phones. 

I understand that audio recording of FHO workshops and jams is generally allowed unless the artist requests no audio recording. Taking video recordings of my computer screen during a workshop or jam is only allowed if it is invited or pre-authorized by the artist.  I agree not to record audio or video of concerts at FHO, including the Saturday Night Concert.  Again, all these sessions are planned to be viewable and replayable during the event and for three months (extensible to six or nine months) afterwards, through the Whova event portal on laptops, tablets, and phones. Additionally, audio recording of some tunes and songs taught during workshops may be provided after the workshop by certain instructors.

I understand that seeing and hearing FHO sessions on my laptop, tablet, or phone may be adversely impacted by my wireless internet speed, simultaneous Internet use at my location (such as additional Zoom usage, gaming, or video streaming; or connections by additional devices such as phones), software settings, and other factors. I am aware that FHO will provide guidance for best practices to maximize my listening, viewing, and participating experience. I will not hold Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, or assigns liable nor be due a refund in the event of technology difficulties or errors on my part or by FHO.

I expressly agree that I assume any and all risks associated with participating in and/or attending virtual workshops, jams, concerts, and any and all other activities related to FHO in 2025. I expressly agree that Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns shall not be liable or responsible for any injury to me or others, or any damage to or loss of my property or that of others, including musical instruments. I release, acquit, discharge, and agree to hold harmless Fiddle Hell Massachusetts LLC, its members, managers, officers, employees, independent contractors, agents, representatives, and assigns against any claim, loss, liability, bodily injury, damage, or expense to myself or my property, or others or their property, which I may, directly or indirectly, sustain or suffer as a result of participation in and/or attendance at FHO, including, but not limited to, any and all liability caused by or contributed to by the negligence and/or gross negligence of Fiddle Hell Massachusetts LLC,  its members, managers, officers, employees, independent contractors, agents, representatives, and assigns, or FHO participants or attendees.
